1. About these terms

These terms apply when you use tracelement.com, autovisibility.tracelement.com or autostrategy.tracelement.com, or buy AutoVisibility or AutoStrategy. The websites are run by Tracy Michelle Edgar, trading as TracElement Group (ABN 74 543 690 334), Melbourne, Victoria ("TracElement", "we", "us").

By using our websites, you agree to these terms. If you engage us for consulting, website or fractional CMO services, our Client Terms in your proposal also apply.

We may update these terms by publishing a new version on this page. The version in force when you buy a product applies to that purchase.

2. Using our websites

 

You may browse, read and share our content for personal or business interest. You must not use our websites unlawfully, try to gain unauthorised access, introduce malicious code, overload our systems, or scrape or copy content in bulk. We may suspend access if these terms are breached.

3. Our content

 

The text, graphics, logos, frameworks, tools and downloads on our websites are owned by or licensed to us. You may quote and share them with credit to TracElement and a link to the source. Any other copying, adapting or republishing needs our written permission, except as allowed under the Copyright Act 1968 (Cth).

4. Information only, no guaranteed results

 

Content on our websites, blogs and free resources is general information. It does not take your circumstances into account and is not legal, financial or tax advice. Some content and all AutoVisibility and AutoStrategy reports are produced with the help of AI and may contain errors. Marketing results depend on many things outside our control, so we do not guarantee rankings, traffic, leads, sales or AI visibility.

5. AutoVisibility and AutoStrategy

  • How they work. You run the tools yourself. Reports are generated automatically from the publicly available pages of the website you enter and the answers you give. You are responsible for entering accurate details and for having the right to analyse the website you enter.

  • Payment. Prices are in Australian dollars and are the total shown at checkout. Payment is taken in full through Stripe. We do not see or store your card number.

​

  • Your account. Keep your login secure and do not share your account. We may suspend accounts used unlawfully or to resell, scrape or copy our tools.

​

  • Refunds. Reports are generated instantly, so we do not offer refunds for change of mind once a report has been generated. If a report clearly failed to read your website, contact us within 14 days and we will re-run it or refund you.

​

  • Subscriptions. Subscription plans renew automatically each billing period until you cancel. You can cancel at any time, effective at the end of the current period. Unused allowances do not roll over. We will give at least 30 days' notice of any price change.

​

  • Using your report. You may use your reports for your own business and share them with your staff, advisers and suppliers. Reselling, white-labelling or publishing them as your own product needs our written agreement. The tools, their methods and report formats remain ours.

6. Your consumer rights and our liability

 

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

To the extent the law allows:

  • our websites are provided "as is", and we do not guarantee they will always be available, secure or error-free;

​

  • we are not liable for loss of profit, revenue, data or opportunity, or for indirect or consequential loss, from using our websites or products; and

​

  • our total liability for a product is limited to the amount you paid for it.

​

7. Links, privacy and cookies

 

Our websites may link to other sites. We are not responsible for their content or privacy practices. How we handle personal information and cookies is explained in our Privacy Policy.

8. Governing law and contact

 

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction.
